If you have clients harmed by Cooper Surgical IVF defective embryonic solution, please reach out to us. If a client’s embryo was tainted or killed by this solution, we can file your client’s CooperSurgical in vitro fertilization lawsuit. On December 5, 2023 Cooper surgical issued a medical product field safety notice because it became aware of the sudden increase in complaints regarding certain lots of its media failing. They stated “while we do not know the cause of the performance concern, due to the high volume of customer complaints for the three associated lots, we wish to proactively address any possible issue With our products while we continue to investigate.”
Cases are being filed across the country against CooperSurgical for these IVF lawsuits claiming CooperSurgical’s solution for growing embryos during in vitro fertilization destroyed the embryos. The injury to plaintiffs who went to great expense and emotional toil in the effort to have children is significant. Presently there are cases pending in the Northern District of California given the residence of the parent Company Cooper Companies. However, Cooper Companies has moved to dismiss claiming they are merely the parent company and Cooper Surgical, the manufacturer of the media is a Connecticut headquartered company. Cooper Surgical moved to dismiss or to change venue claiming the Northern District of California is an improper venue. We are part of an informal coordination amongst several firms handling these cases and are awaiting the outcome of that motion practice because if the litigation remains there, we will likely file our cases in Northern District of California given it is a good venue. We are also considering filing in state or federal court in Connecticut, which are also good venues. It is possible an MDL may be sought if the informal coordination in California is unsuccessful.

The full scale of the potential harm is not yet known. We have been contacted by potential clients who had their embryos fail during a time period and lot not covered by the recall and we believe it is possible the recall was too limited and may expand over time.
